2011 Notable Victories!

The Attorneys and staff at Neil Rockind, P.C. are currently working on nearly 100 on-going cases, however, below is our list of outstanding victories from 2011. Please note, this list is in no way meant to be exhaustive; these are simply our honorable mentions.

2011

December 2011 – Livonia, MI – Individual lost her license due to an Operating While Intoxicated 2nd Offense. Neil Rockind, P.C. helped her through the license restoration process with the Drivers License Appellate Division and she RECEIVED HER LICENSE BACK AT THE FIRST REQUEST!

November 2011 – Rochester Hills, MI – Client, a college student, was charged with Minor in Possession of Alcohol after his dorm room was searched by school officials. Neil Rockind, P.C. got involved and convinced the prosecutor that the alcohol did not belong to our client. ENTIRE CASE DISMISSED!

November 2011 – Roseville, MI – Individual charged with a violation of probation for allegedly using the internet in violation of his probation requirements – CHARGE DISMISSED after Neil Rockind appeared at the first court appearance!

November 2011 – Huron Township, MI – Individual charged with Receiving and Concealing Stolen Property (a 5-year Felony) – came to our office and maintained his innocence from the beginning. At the Preliminary Examination, the Judge wrongly ruled that the prosecution had enough evidence. Once in the Wayne County Circuit Court, Neil Rockind, P.C. filed a Motion to Quash the charge. On the date of the hearing on the Motion to Quash, the prosecutor, who failed to file a response to our motion, refused to discuss any possible resolution of the case and told Neil Rockind that he was “sure he would prevail because he had never seen the Judge grant such a motion. Less than an hour later THE JUDGE GRANTED THE MOTION TO QUASH AND DISMISSED THE CASE!

November 2011 – Ann Arbor, MI – Individual charged with Operating While Intoxicated Second Offense – After numerous discussions with the Prosecutor and the Court, the OWI 2nd was DISMISSED pursuant to a plea agreement. Further, her license was NOT suspended for the mandatory 1-year stint! Instead, she will be granted an Ignition Interlock Device.

October 2011 – Detroit Metro Airport – Individual charged with several Felonies and Misdemeanors after becoming intoxicated on a plane, assaulting a plane steward, resisting arrest, obstructing justice, and assaulting several police officers, including hitting and kicking several police officers before being subdued by a taser. Neil Rockind, P.C. had several conversations with the Wayne County Prosecutor’s Office and negotiated a COMPLETE DISMISSAL of ALL CHARGES with the exception of ONE MISDEMEANOR, which was TAKEN UNDER DIVSERSION!

October 2011 – Farmington Hills, MI – Individual charged with Operating While Intoxicated 3rd Offense in Oakland County – LOWEST SENTENCE POSSIBLE: 30 days jail (this is the absolute lowest jail sentence that the judge can legally give and is extremely rare in Oakland County).

October 2011 – Troy, MIATTENTION: GROUND BREAKING VICTORY! – A non-medical marijuana patient was charged with Operating a Motor Vehicle with ANY Presence of Marijuana in his system (pursuant to MCL 257.625(8)). Neil Rockind, P.C. filed two motions: one challenging the placement of marijuana as a schedule 1 substance (since the medical marijuana act now recognizes the medical uses of marijuana) and a 2nd motion challenging MCL 257.625(8) under the equal protection clause, given the fact that the law irrationally treats medical marijuana users and non-medical marijuana users differently – following two separate hearings, THE JUDGE DISMISSED THE ENTIRE CASE and FOUND THAT MCL 257.625(8) is UNCONSTITUTIONAL and that MARIJUANA IS NO LONGER A SCHEDULE 1 CONTROLLED SUBSTANCE!

October 2011 – Trenton, MI - Individual charged with Operating While Intoxicated Second Offense – After numerous discussions with the Prosecutor and the Court, his license was NOT suspended for the mandatory 1-year stint! Instead, he is on a Ignition Interlock Device.

October 2011 – Rochester Hills, MI – Individual charged with Possession of Marijuana and Possession of Paraphernalia – Count 1 was taken UNDER ADVISEMENT (pursuant to 7411) and Count 2 was DISMISSED!

October 2011 – Livonia, MI – Individual applied with the Secretary of State’s Drivers License Appellate Division to re-obtain his driver’s license after losing it to an OWI 2nd. This was his first application to receive his license after his mandatory 1 year minimum revocation and his request was GRANTED! (It is very rare to receive your license back on your first request.)

October 2011 – West Bloomfield, MI – A medical marijuana patient was charged with Operating a Motor Vehicle Under the Influence of Marijuana – Neil Rockind, P.C. filed a single motion and the case was DISMISSED!

September 2011 – Rochester Hills, MI – Individual charged with Reckless Driving for intentionally driving the wrong way down a one way street – REDUCED TO CARELESS DRIVING!

September 2011 – Southfield, MI – Individual charged with Retail Fraud for allegedly stealing several hundred dollars worth of DVD’S – after several negotiations with the prosecutor’s office and the court, the charge was taken UNDER ADVISEMENT for 6 months and ULTIMATELY DISMISSED!

September 2011 – Berkley, MI – Individual charged under the newly enacted “Super-Drunk” law with Operating While Intoxicated with a blood alcohol content of .21 BAC.  After a grueling battle with the Oakland County Prosecutor’s Office, the sentence was reduced to probation!

September 2011 – Allen Park, MI – Individual charged with a Violation of Probation for Disorderly Conduct – DISMISSED after Neil Rockind, P.C. appeared on behalf of the client!

September 2011 – Southfield, MI – Individual charged in Oakland County with several felonies, including Manufacture of Marijuana, Felon in Possession of a Firearm, and Felony Firearm (which carries with it a mandatory 2 years in prison) – his first attorney told him “there’s not much that can be done” – Neil Rockind, P.C. stepped in, filed a Motion to Suppress all evidence that was seized at his residence and the motion was GRANTED! Following the suppression of the evidence, the Court of Appeals denied the prosecutor’s Appeal and ALL OF THE CHARGES WERE DISMISSED!

August 2011 – Southfield, MI - Individual charged with Operating While Intoxicated – after Neil Rockind, P.C. got involved and filed a Motion to Suppress the Evidence, the prosecutor reduced the charge to CARELESS DRIVING!

August 2011 – Shelby Township, MI – Individual charged with five (5) felonies, including Delivery/Manufacture of Marijuana, Delivery/Manufacture of Adderol, Delivery/Manufacture of Steroids, Maintaining a Drug House and Felony Firearm (which is a mandatory 2 years in prison) – Neil Rockind, P.C. was able to negotiate a plea with the prosecutors office that included the dismissal of multiple felonies, including the Felony Firearm, and a sentencing agreement to PROBATION!

August 2011 – Bloomfield Township, MI – Individual charged with driving nearly 30 miles per hour over the posted speed limit – charge reduced to a Double Parking ticket!

July 2011 – Troy, MI – Individual charged in 2 separate cases with 4 Felonies and 2 Misdemeanors all regarding the actual possession of dangerous drugs – 7411 GRANTED ON ALL FELONIES! (In Oakland County it is extremely rare for a defendant to receive 7411 on multiple counts – especially when they span over 2 separate cases.)

July 2011 – Detroit, MI – Individual lost his license due to an implied consent violation – NRPC helped him WIN a hardship appeal and his license was reinstated!

June 2011 – Detroit, MI – Individual charged with Felony Fleeing and Eluding Police for an alleged 100 mph police chase that started in Dearborn Heights, ended in Detroit, and spanned nearly 10 miles – CASE DISMISSED!

June 2011 – Ann Arbor, MI – Individual charged with Reckless Driving – CHARGE DISMISSED!

June 2011 – Pontiac, MI – Individual charged with Felony Receiving and Concealing Stolen Property totaling more than $1,000.00 – FELONY DISMISSED and only 6 months of non-reporting probation!

May 2011 – Famington Hills, MI – Individual charged with Operating While Intoxicated Second Offense – After numerous discussions with the Court, his license was NOT suspended for the mandatory 1-year stint! Instead, he is on a Ignition Interlock Device.

May 2011 – New Baltimore, MI – Individual charged with Operating While Intoxicated Third Offense – FELONY DISMISSED pursuant to a misdemeanor plea agreement!

May 2011 – Shelby Township, MI – Individual charged with Leaving the Scene of a Personal Injury Accident – DISMISSED pursuant to plea agreement!

May 2011 – Romeo, MI – Individual charged with Driving While License Suspended – DISMISSED pursuant to plea agreement!

April 2011 – Oakland County, MI – Individual reinstated with full driving privileges after Neil Rockind, P.C. challenged an abuse of discretion by the Michigan Secretary of State!

April 2011 – US District Court for the Eastern District of Michigan – Individual charged with conspiring to smuggle hundreds of pounds of marijuana and hundreds of thousands of pills of Ecstasy into the United States – Sentence: 5 years of SUPERVISED RELEASE! No additional incarceration!

April 2011 – Troy, MI - Individual charged with Operating While Intoxicated Third Offense – Sentenced to 60 days home tether! No incarceration within the jail!

April 2011 – Bloomfield Hills, MI – Individual charged with Retail Fraud -Plea Under Advisement in the 48th District Court (this type of outcome in this Court is unheard of!)

April 2011 – Livonia, MI – Individual charged with Operating While Intoxicated Second Offense and the alternative charge of Superdrunk Driving – Plead to Impaired Driving and After numerous discussions with the Court, his license was NOT suspended for the mandatory 1-year stint! Instead, he is on a Ignition Interlock Device.

April 2011 – Farmington Hills and Pontiac, MI – Individual charged with Smuggling Contraband into a Jail, Delivery of a Controlled Substance, and Manufacture of Marijuana – Sentenced to PROBATION! No incarceration, even though the Prosecutor’s Office demanded it! 

April 2011 – Oak Park, MI – Individual charged with several counts of illegal use of a Financial Transaction Device (credit cards) – After months of hearings and testimony – ALL CHARGES DISMISSED!

April 2011 – Warren, MI - Two individuals charged with Malicious Destruction of Property – Both received Under Advisement status (the ability to have the charge dismissed if they comply with their probation requirements) and a mere 6 months of probation (despite the objection of the prosecutor)!

March 2011 – Troy, MI – Individual charged with Operating While Intoxicated Second Offense – NO INCARCERATION!

March 2011 – Oak Park, MI – Individual charged with Assault and Battery – NOT GUILTY AT TRIAL!

March 2011 – Plymouth, MI – Individual charged with Felonious Possession of Cocaine – the FELONY was DISMISSED pursuant to a plea agreement!

March 2011 – Troy, MI - Individual charged with Felonious Embezzlement for allegedly embezzling nearly $15,000 from her place of employment – Sentence: 6 months of NON-REPORTING PROBATION!

March 2011 – Troy, MI – Individual charged with Assault and Battery (including the alleged display of a firearm) – NOT GUILTY AT TRIAL!

March 2011 – Beverly Hills, MI – Individual charged with Felonious Possession of Cocaine – DISMISSED ON THE DAY OF TRIAL!

March 2011 – West Bloomfield, MI – Individual’s house was raided by the Oakland County Narcotics Enforcement Team (NET) who confiscated over $50,000 worth of supplies after they received an anonymous tip that he was growing marijuana. However, he was growing medical marijuana, was doing so legally, and had all of the paperwork to prove it. After intervention by Neil Rockind, P.C. – NO CHARGES FILED and investigation dropped!

February 2011 – Birmingham, MI - Individual charged with a Misdemeanor Violation of her Restricted Driver’s License – DISMISSED! (after several discussions with the prosecutor.)

February 2011 – Bloomfield Hills, MI - Individual investigated by police and the Oakland County Prosecutor’s Office for over 6 months for allegedly forging two (2) Circuit Court Judge’s signatures – After intervention by Neil Rockind, P.C. – NO CHARGES FILED and investigation dropped!

February 2011 – Birmingham, MI - Individual charged with Contempt of Court for outright lying to a District Court Judge – NO JAIL SENTENCE!

February 2011 – Plymouth, MI – Individual charged with Felony Possession of Cocaine – Felony DISMISSED at the Preliminary Examination!

February 2011 – Troy, MI - Individual charged with Felony Embezzlement $1,000 – $20,000 – HALF-WAY through the Preliminary Examination the FELONY was DISMISSED! (in exchange for a plea to misdemeanor larceny)

January 2011 – New Baltimore, MI – Individual charged with Larceny from a Building (a 4-year FELONY) and Embezzlement – ALL CHARGES DISMISSED AT THE PRELIMINARY EXAMINATION!

January 2011 – Detroit, MI – Individual charged as a repeat drunk driving offender – STRAIGHT PROBATION, NO INCARCERATION!

January 2011 – Birmingham, MI – Individual charged with Assault and Battery and Intoxicated Disorderly Person – ALL CHARGES DISMISSED! (2 days before trial.)

January 2011 – Eastpointe, MI – Individual charged with Possession of a Dangerous Weapon – Charge DISMISSED! (after several discussions with the prosecutor.)

January 2011 – Beverly Hills, MI - Individual charged with Domestic Violence – Case DISMISSED at Trial!

January 2011 – Shelby Township, MI – Individual plead guilty to one count of Operating While Impaired – Sentence: 1 day alcohol education class; NO JAIL, NO PROBATION, NO COMMUNITY SERVICE!

January 2011 – Bloomfield Hills, MI – Individual charged with a violation of probation in the 48th District Court for both failing to perform an alcohol test (JAMS) within the allotted time period AND for missing an alcohol test (JAMS) – Sentence: a mere 21 days of daily PBT’S! NO JAIL!

January 2011 – Plymouth, MI - Individual charged with Operating While Intoxicated after blowing .16 and .15 on the Datamaster – DISMISSED!
